ASSUMPTIONS OF RISKS AND INDEMNITY AGREEMENT, WAIVER OF CLAIMS, RELEASE OF LIABILITY

The waiver form must be submitted for any shuttle rides you wish to participate in. If you are under 18, you will need a parent or guardian to complete and sign the form.

IMPORTANT: Take a screenshot of the confirmation screen that appears after you submit the form, and save the email on your phone to be able to quickly display your signed waiver to BUMP officials.

Definitions

For the purposes of this agreement the following terms shall be defined as follows:

The term “Releasees” shall mean the Birmingham Urban Mountain Pedalers (“BUMP”), its directors, officers, employees, guides, independent contractors, volunteers, sponsors, promoters, advertisers, successors, agents, representatives and assigns.

The term “Mountain Biking” shall include all activities, events, services, transportation and use of facilities provided, organized, conducted for or arranged by the Releasees including but not limited to: cycling, bike descents, mountain bike touring, hiking, training, use of trails and roads in the recreation area, races, competitions, instructional courses or any other activity related to the riding of bicycles and any other vehicles (whether propelled by the rider thereof, self-propelled, or otherwise) including but not limited to, orientation and instructional sessions, transportation, accommodation and recreational activities in addition to bicycling, loading, unloading, and travel in or movement around the recreation area, and other activities in the recreation area.

Release of Liability, Waiver of Claims

By signing this agreement and in exchange for good and valuable consideration, I, on behalf of myself, my heirs, personal representatives, or assigns, DO HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Releasees, their directors, officers, employees, volunteers, independent contractors, and agents from liability FROM ANY AND ALL CLAIMS against Releasees arising from or related injuries or damage sustained to myself or my equipment while Mountain Biking.

This agreement applies to 1) personal injury (including death) from accidents or illnesses arising from participation in Mountain Biking and to 2) any and all claims resulting from the damage to, loss of, or theft of personal property.

Acknowledgment and Assumption of Risks

I acknowledge and accept that Mountain Biking involves risks, dangers and hazards in addition to those normally associated with bicycle riding and that injuries are a common and expected part of Mountain Biking. Mountain Biking takes place on steep and rugged terrain and will expose the rider/participant to many risks, dangers and hazards. The Terrain may be uninspected, uncontrolled and unsafe due to constantly changing conditions. The inherent risks, hazards and dangers include but are not limited to the following:

Collision with other riders, vehicles, bicycles, trees, tree stumps, tree well or other objects;
Fences and other man-made structures;
Mechanical failure of equipment;
Rapid and uncontrolled acceleration on hills and inclines;
Changing weather conditions;
Unsafe terrain-including steep or slippery sections, cliffs, rocks, holes or crevasses;
Extreme variation in cycling terrain;
Encounters with domestic and non-domestic animals;
Negligence of the part of the Release-including the failure to protect the participant from the risks, dangers and hazards of Mountain Biking or to predict whether the terrain is safe for Mountain Biking;
Negligence of other riders, bystanders, volunteers, and persons in the Mountain Biking area; and
Damage or injury to persons or equipment occurring in the loading, unloading, and transportation of bikes and equipment.

I am aware of the risks, dangers and hazards associated with Mountain Biking and I freely accept and fully assume all such risks, dangers and hazards as the possibility of personal injury, death, property, damage or loss resulting therefrom, all of which may result in serious bodily injury or death to the rider/participant.

Confirmation

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS AGREEMENT PRIOR TO SIGNING MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
